Las sentencias casatorias de la Corte Suprema y la valoración racional de la prueba en el proceso penal

Abstract

La investigación tiene como objetivo determinar la influencia que ejercen las sentencias de la Corte Suprema, en la formación de la valoración probatoria en el proceso penal, en el ejercicio de sus funciones casatorias. Se utilizó para alcanzar dicho objetivo el método deductivo, inductivo y descriptivo y un diseño no experimental; asimismo la población objeto estuvo constituida por cien personas entre jueces, fiscales y abogados especializados en materia penal. Al calcular el tamaño de la muestra se trabajó finalmente con 75 personas. En cuanto al instrumento de recolección de datos, tenemos al cuestionario que fue validado por expertos; para ello realizaron la evaluación tres Doctores en Derecho los que validaron los criterios; el instrumento constó de 15 ítems de tipo cerrado, cuyos resultados se vaciaron en tablas, en las cuales se calcularon las frecuencias y porcentajes, complementándose con el análisis e interpretación de los resultados, lo cual nos permitió contrastar las hipótesis. La prueba estadística utilizada fue la prueba chi cuadrado y el margen de error utilizado fue 0.05. Finalmente se concluyó que las sentencias casatorias de la Corte Suprema influyen positivamente en el sistema de valoración racional de la prueba en el proceso penal. Ello queda demostrado debido a que los resultados de los estadísticos de las hipótesis, siempre son mayores al valor referencial del criterio de distribución de chi cuadrado que es 16.919; en ese sentido la hipótesis general nula es rechazada.

The objective of the investigation, is to determine the influence of the Supreme Court's judgments on the formation of the evidentiary valuation in the criminal process, in the exercise of its cassation functions. The deductive, inductive and descriptive method and a non-experimental design were used to achieve this objective, and the target population was constituted by 100 people among judges, prosecutors and lawyers specializing in criminal matters. When calculating the sample size, we finally worked with 75 people. Regarding the data collection instrument, we have the questionnaire that was validated by experts, for which the 3 Doctors in Law evaluation validated the same criteria that consisted of 15 items of closed type, the same ones that were emptied into tables where the frequencies and percentages were calculated, complementing with the analysis and interpretation of the results, which allowed us to contrast the hypotheses. The statistical test used was the chi square test, the margin of error used was 0.05. Finally, it was concluded that the casatorial judgments of the Supreme Court positively influence the system of rational evaluation of the evidence in the criminal procedure. It is demonstrated because the results of the statistics of the hypotheses are always greater than the reference value of the chi-square distribution criterion, which is 16.919; in that sense the null general hypothesis is rejected.
