Inobservancia del régimen de visitas y los derechos fundamentales del niño

Abstract

El presente trabajo de investigación tuvo como objetivo general, “determinar cómo la inobservancia del régimen de visitas, vulnera los derechos de alimentos del niño en los juzgados de familia de Lima Sur”. El tipo de investigación es cualitativa. El nivel de investigación fue aplicado, tipo descriptivo, método ex-post facto. Los instrumentos que se utilizaron en el trabajo de tesis fueron los siguientes: ficha será el instrumento de indagación que permitirá incorporar y sistematizar los contenidos de la investigación y organizar las fuentes a las que se acude; e instrumento de análisis de contenido. Resultados, de los expedientes analizados se evidencia que la mayoría de los juicios se enfocan en el hecho que la inobservancia del régimen de visitas incide directamente en la vulneración de los derechos fundamentales del niño; en especial en aquellas dimensiones que afectan o pueden afectar su desarrollo físico y psicológico, el derecho a tener una familia y contar con una forma de comunicación estable y constructiva con sus progenitores. Asimismo, se pone en relevancia que los operadores de justicia en general otorgan más importancia en estas dimensiones de forma tal que puedan desenvolverse en la vida adulta. Sin embargo, la construcción de una relación positiva entre los padres, que favorezca el clima de armonía para el desarrollo del menor, no siempre se encuentra garantizado por el resultado de la acción judicial.

The general objective of this research was to "Determine how the non-observance of the visitation regime violates the child's food rights in the family courts of South Lima". The type of research is qualitative. The level of research was applied, descriptive type, ex-post facto method. Results: From the files analyzed it is evident that the majority of the trials focus on the fact that the failure to observe the visitation regime directly affects the violation of the fundamental rights of the child; in space in those situations that affect or may affect their physical and psychological development, the right to tenewre a family and have a stable and constructive form of communication with their parents. It is also relevant that justice operators in general give more importance to these dimensions in such a way that they can function in adult life. However, the construction of a positive relationship between the parents, which favors the climate of harmony for the child's development, is not always guaranteed by the result of the judicial action.
