La impugnación de reconocimiento de paternidad extramatrimonial y el derecho a la identidad en la legislación civil peruana

Abstract

El tema que se investigó es muy importante, dado que muchos niños vienen siendo perjudicados porque sus progenitores no quieren reconocerlos, teniendo como única defensa a la justicia, quien tiene como misión velar por los derechos de las personas, debiendo señalar que se realice una prueba de ADN el padre y así el menor pueda conocer su origen y tener derecho a una identidad, el cual se encuentra establecido en nuestra norma sustantiva vigente y así el niño pueda desarrollarse dentro de una familia.

The subject that was investigated is very important, given that many children are being harmed because their parents do not want to recognize them, having as their only defense the justice, whose mission is to watch over the rights of the people, pointing out that a test is carried out of DNA the father and thus the child can know their origin and have the right to an identity, which is established in our current substantive norm and so the child can develop within a family.
